Yep, it happens all the time. Typically, the tenant is the one that calls the inspector to report a violation.

Hi,
Just reading your blog. Can you tell me if an inspector for DNS has the right to enter a rental property (fully occupied), if the tenant lets him in, without the knowledge of the owner/landlord? Is it legal for him to enter and begin his inspection without owner's knowledge?

Good question Chris --- I would certainly try to prove that it is occupied by some means other then allowing the inspector into your unit.

DNS' new budget request allowed for the hiring of several new inspectors. The budget was accepted and passed. So there are new inspectors to assist in the enforcement of the Vacant Building ordinance and the Residential Rental Certificate ordinance.

How do you prove a unit is occupied?

Maybe have your client bring the inspector in while the tenant is sleeping in bed?

The city doesn't have the manpower to inspect Occupied houses with outside code violations, how's it going to find the time to do this.

I have a unit that I don't consider a rental unit, for the past 5 yrs, I have used it strictly for storage, -tools, plumbing fixtures, yard equipment, etc. I don't know how to explain that to the city, I guess I'm screwed.

Another reason for me to get the hell out of the landlord business and out of Milwaukee period. This city does nothing for people trying to improve the housing stock other than to harass and intimidate them. Luckily, the few units I have are not required to be registered under the terms of this program. how about the city doing something to stop crime and the idiots who do the breaking and vandalizing???
