Lorrie -- I would certainly reccomend consulting an attorney. I know that here in Wisconsin to attack and ordinance on its face as unconstitutional which is what the plaintiffs did, was very difficult. the burden to meet was too high. but possibly that would be different in your jurisdiction. I also know that there is an organization that has sued the city of Red Wing Minnesoat re: such an ordinance, I believe. I would reccomend that you contact the attorney handling that case as well for input.

It sounds exactly like what we are going through here in Bemidji, MN with the City Council attempting to draft and pass a rental ordiance without re for long term ramifications being considered. We are afraid that with the current state of economy and increased number of foreclosures, the ordainace will palce undo finacnial stress on struggling Landlords and we may see an already fragil and aging housing market, decline yet more. Has there been any lessons we can take from your experience and apply to our situation. We have some members who want to consult an attorney but sounds like that was futile as well. Any advice or suggestions you have would be appreciated.
Sincerly, Lorrie
