Mike -- If you can prove that you are a full-time employee of your LLC then you can appear on behalf of the LLC in small claims court in Wisconsin. In Milwaukee County, the court asks for prrof of full time employment such as a paycheck stub showing that the LLC paid your wages and that you work Full-time. Most members of LLC's do not pay themselves a paycheck from the LLC.

If my future service company LAWNMOWERMAN LLC, does repairs to lawnmowers full time for apartment owners so much that its a full time income, verifiable via cpa and tax reporting a w-2, can I appear in court on behalf of the LLC?
For the past two years I have been trying to take a very much needed service like lawnmower repair and tie it into a service like much needed specialized representation of LLC appearance in court. After 15 years as Realtor and National Securities Dealer, references available.

Frances -- That is the rub - very few members of an LLC can prove they are a full time employee of the LLC - often becasue they aren't. Member's are rarely paid a salary from the LLC.

For your upcoming case, you will need to bring the lawsuit in the name of the owner of the property -- the LLC -- so if you cannot satsfy the court that you are a full time employee of the LLC, then you will need to retain a lawyer to represent the LLC.

As the sole owner/member/contact person etc of my LLC, how exactly do I support that with out a W2?

I am taking an ex-tenant to court in 2 months for the judgement of money. At the time of her lease I did not have the property in an LLC. This is smalls claims court. Am I safe to represent myself, the LLC was transferes after I rerented.
