I am in the process of evicting a woman who alleges her husband sexually abused her (case is pending) w/ a TRO issued. He lost his job and she chooses not to work (and she is not disabled). These folks were late w/ rent prior to the incident, but I served the 5 day after he was arrested and have retained an attorney to handle the eviction (realizing this could get ugly). While I would never deny an applicant who is a victim of absue the chance of renting, I certainly hope the courts consider all variables when eviction is concerned. The victim should have protection from their abuser, but I hope the court adheres to the facts of the eviction (non-payment of rent) first. Seems as though landlords take the fall for so many of the bad seed tenants. I simply want to regain my property.
